OnTheMarket dispute: solicitors say more than 50 agents begin proceedings

Solicitors’ company Tollers says more than 50 estate agents have now formally instructed it in relation to claims against Agents’ Mutual, the parent company of OnTheMarket.

A statement over the weekend from Tollers partner Ian Carson says: “We are are pleased to be offering our services to represent a significant number of estate agents who feel aggrieved at the actions taken by Agents’ Mutual. We are in the course of preparing the claim which we will be putting to Agents’ Mutual shortly.”

Carson also confirmed that his practice is seeking any other agency that wants to join the action. “If any other affected parties want to find out more about the Action Group, they are welcome to attend one of three information sessions I’m hosting in Birmingham, Manchester and Leeds” he says, seeking them to register on the action group’s website.

The sessions are being held in Birmingham on June 30, and in Manchester and Leeds on July 1.

The group claims the estate agents believe they were misled over promises made on joining that their subscription fees would always be equal to, or lower than, members who joined at a later date. It has now been suggested that, instead, Agents Mutual has been offering subscriptions at a much lower price, disadvantaging earlier members.

Agents’ Mutual has been approached by Estate Agent Today but a spokeswoman says the portal is declining to comment.

    AM are not offering lower fees. They are having a sale. Nothing wrong with that - everybody does it.

    @ Hafsid. No smoke without sparks. Guess the protest barristers must have seen something irregular.

    Onwards for sure AM/OTM have cartel like/ anti-competitive retraints in place which is a NO NO.

    Initially OTM did sell their services under the promise to adhere to a fix fee structure that saw early adopters receive slightly lower fees - circa £400pcm.
    My most recent sales call from OTM offered membership for just £50pcm.
    Existing loyal members are still paying the original higher rate.
    Had I been an early subscriber I would have felt mislead.
