This week sees the start of the Competition Appeal Tribunal court case between Agents’ Mutual Ltd and Gascoigne Halman Ltd.
The case hinges around the application of the ‘one other portal rule.’ Gascoigne Halman, an early ‘gold’ member of the Agents’ Mutual portal OnTheMarket, was later acquired by Connells.
In a number of preliminary hearings and conferences, submissions and rejoinders have been made by both parties, and potential cost issues have been agreed.
A pre-trial review in respect of the competition issues and experts’ statements was held last month.
Now, on Friday of this week, the trial proper is scheduled to commence. The proceedings have been listed to conclude on February 20.
